The Planning Board met briefly prior to Town Meeting to continue the site plan review with Tedeschi’s Food Shops.

 

Ms. Bingham reviewed the replay of the meeting she missed so she was equipped to vote.

 

A discussion ensued regarding the draft decision of the site plan.

 

A discussion ensued regarding the height of the canopy, with respect to the stormwater easement and truck clearance.

 

There was a discussion regarding the proposed and existing signs.

 

There was a discussion of the new circulation plan, with restricted one-way exit out of southern driveway.

 

Tom Houston said the existing condition and the proposed plan are equally safe for pedestrians.  He said the originally proposed plan would have been less safe than the current plan.

 

Mr. O’Cain left the meeting at 6:50PM.

 

There was a discussion of truck and delivery access.

 

Ms. Bingham moved to approve the 5 page site plan only (not the other submissions from the applicant such as turning plans, landscaping, elevations, signs, or lighting) dated 10/14/11 and most recently revised 5/4/12, with conditions:

1.  The proposed site improvements shall fully comply with the following Site Plan, as may be amended from time to time by approval of the Planning Board or the Town Engineer, as the agent of the Planning Board:

“Proposed Site Plan, 68 Pond Street, Sharon, Massachusetts” prepared by Merrill & Associates, consisting of 5 sheets, which shall be amended to show one-way traffic exiting only at the southernmost entranceway and the appropriate pavement markings, entitled as follows: 

(1) “Cover Sheet,” Cover/Index dated October 14, 2011, last revised April 19, 2012;

(2) “Area Plan,” dated October 14, 2011, last revised April 19, 2012;

(3) “Existing Conditions,” dated October 14, 2011, not revised;

(4) “Layout & Zoning”, dated October 14, 2011, last revised May 4, 2012; and

(5) “Details” dated October 14, 2011, last revised April 19, 2012.

2.  The Zoning & Environmental Constraints table on “Layout & Zoning,” Sheet 4 of 5, of the Site Plan shall be revised to label the building coverage requirement as a maximum, and the proposed and existing building coverage with and without the canopy.

3.  Prior to the issuance of a Building Permit for any of the improvements to be made as authorized hereunder, the Applicant shall complete the Site Plan review process with the Planning Board for the additional site improvements including Lighting, Landscaping, Building Elevations, and Signs.

4.  Prior to the issuance of a Building Permit for the relocated Gasoline Dispensers, the Applicant shall provide proof to the Town Engineer or the Planning Board that the Fire Chief for the Town of Sharon has approved the adequacy of the Fire Protection System, the proposed Dispensers, the proposed Underground Storage Tanks, proposed tank vents and their location, and all aspects of the fueling system to include the concrete slab with positive limiting barrier and the Fire Protection System mounting in the canopy.

5.  Prior to the issuance of a Building Permit for any of the improvements to be made as authorized hereunder, the Applicant shall provide construction plans to the Town Engineer or the Planning Board removing any gas vents located within the drainage easement, and showing grading, site drainage and canopy drainage connecting to the existing storm drains within the easements on the Site, and tank and piping plans showing the type and location of tanks, fuel piping, and related items.

6.  Prior to the issuance of any Certificate of Occupancy for improvements to be made within the Site as proposed herein, the Applicant shall provide an As-Built Plan showing the above ground improvements being made, including the building addition, canopy and dispenser relocation, and a Contractor’s red-line sketch of the underground improvements being made, including fuel tanks and fuel lines, conduits and drainage for the canopy (not including exiting water, sewer, gas or electrical conduits already in place and not being replaced) to the Town Engineer for dissemination to the Fire Department and all other Town Departments deemed necessary by the Town Engineer.

7.  Prior to the issuance of any Certificate of Occupancy for improvements to be made within the Site as proposed herein, the Applicant shall provide proof to the Town Engineer or the Planning Board that the Board of Health Agent, James Andrews, has accepted the passing Title 5 Inspection for the existing on-site septic system as adequate for the proposed improvements.

8. There shall be sufficient clearance beneath the canopy to allow for delivery vehicles and for access to the stormwater easement.

9.  The Applicant/Owner shall require that the fuel delivery trucks enter the site from the southern entrance, that the fueling shall typically occur between 9:00 and 11:00 PM, and that the truck’s engine shall be turned off quickly so as not to cause excess noise for the neighbors.

 

Mr. Pannone seconded the motion and the Board voted 5-0-0 in favor of approval.

 

Adjournment

Mr. Milowe moved to adjourn the meeting at 7:08 PM and Mr. Pannone seconded the motion. The Board voted 5-0-0 in favor of adjournment.
